Xeebi Mobile Inc. ("Company", "we", "us", or "our") is committed to protecting your personal information and your right to privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website at xeebi.com or use our messaging platform and related services (collectively, the "Xeebi Services"). Please read this policy carefully. If you disagree with its terms, please discontinue use of the Xeebi Services.

This Privacy Policy applies to all information collected through the Xeebi Services, and any related services, sales, marketing, or events. It does not apply to information collected by third parties, including our customers' end users, except as described below.

As a business-to-business ("B2B") messaging platform, we process two distinct categories of data: (1) data you provide as a business customer of Xeebi ("Customer Data"), and (2) data that passes through our platform on behalf of your end users ("End User Data"). This policy governs both.

Information We Collect

A. Information You Provide to Us
 
Account Registration. When you create an account, we collect your name, company name, email address, phone number, username, and password.
 
Payment Information. When you make a purchase, we collect payment card details, billing address, and transaction records. Payment processing is handled by our payment processor; we do not store full card numbers on our servers.
 
Communications. If you contact us directly (email, support tickets, forms), we collect the content of those communications and any information you choose to include.
 
Professional Information. We may collect information about your business, including industry, company size, and intended use of the Xeebi Services.

B. Information Collected Automatically
 
Log Data. When you access the Xeebi Services, our servers automatically record information including your IP address, browser type and version, pages visited, time and date of your visit, time spent on pages, and other diagnostic data.
 
Usage Data. We collect information about how you use the platform, including message volume, delivery rates, campaign configurations, and feature interactions.
 
Device Information. We collect information about the device you use to access the Xeebi Services, including hardware model, operating system, unique device identifiers, and mobile network information.
 
Cookies and Similar Technologies. We use cookies, web beacons, and similar tracking technologies to collect and store information. See our "Cookies" section below for details.

C. End User Data (Processed on Your Behalf)
 
When you use our platform to send messages to your end users, we process End User Data on your behalf as a data processor. This includes phone numbers, message content, delivery status, opt-in and opt-out records, and consent timestamps. You, as our customer, are the data controller for End User Data. No mobile information — including SMS/MMS originator opt-in data and consent — will be shared with third parties or affiliates for marketing or promotional purposes.

D. Information from Third Parties
 
We may receive information about you from third-party services you connect to the Xeebi Services (such as CRM integrations), from publicly available sources, and from third-party data providers for fraud prevention and identity verification purposes.

How We Use Your Information

We use the information we collect for the following purposes:
 
1.  Providing and Improving the Xeebi Services — to operate, maintain, and improve our platform; to process transactions; to send you service-related notifications; and to provide customer support.
2.  Account Management — to create and manage your account, verify your identity, and authenticate your access.
3.  Billing and Payments — to process payments, prevent fraudulent transactions, and send billing communications.
4.  Communications — to respond to your inquiries; send administrative messages, security alerts, and product updates; and, where you have opted in, send marketing communications about our services.
5.  Analytics and Research — to understand how users interact with the Xeebi Services, identify usage trends, and improve our products and features.
6.  Legal Compliance — to comply with applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA), Telemarketing Sales Rule (TSR), California Consumer Privacy Act (CCPA), and other applicable privacy laws; to respond to lawful requests from public authorities; and to establish, exercise, or defend legal claims.
7.  Safety and Security — to detect, investigate, and prevent fraudulent, abusive, or illegal activity; to monitor for violations of our Terms of Use; and to protect the rights, property, and safety of our users, third parties, and the public.
8.  Processing on Your Behalf — to route, deliver, and track messages you send through our platform to your end users, in accordance with your instructions.

How We Share Your Information

We do not sell your personal information. We may share your information in the following circumstances:
 
A. Service Providers. We share information with third-party vendors and service providers that perform services on our behalf, including payment processing, cloud hosting, data analytics, customer support, email delivery, and fraud prevention. These providers are contractually obligated to protect your information and use it only for the purposes for which it was disclosed.
 
B. Telecommunications Carriers and Third-Party Providers. To deliver messages you send through our platform, we share necessary routing data (including phone numbers and message content) with telecommunications carriers, mobile network operators, and messaging aggregators. These transmissions are necessary to provide the Xeebi Services.
 
C. Business Transfers. If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of company assets, your information may be transferred as part of that transaction. We will notify you via email and/or prominent notice on our website of any change in ownership or uses of your personal information.
 
D. Legal Requirements. We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court order or government agency).
 
E. Protection of Rights. We may disclose information where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, potential threats to the physical safety of any person, violations of our Terms of Use, or as evidence in litigation.
 
F. With Your Consent. We may share your information for any other purpose with your prior consent.
 
SMS Data: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All categories above exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Cookies and Tracking Technologies

We use cookies (small text files stored on your device) and similar tracking technologies to enhance your experience with the Xeebi Services. We use the following types of cookies:
 
Strictly Necessary Cookies — required for the operation of the Xeebi Services (e.g., session authentication, security). These cannot be disabled.
 
Performance Cookies — collect anonymized information about how visitors use the Xeebi Services (e.g., pages visited, errors encountered) to help us improve performance.
 
Functional Cookies — remember your preferences and settings to personalize your experience.
 
Targeting/Analytics Cookies — used to analyze traffic patterns and, where applicable, to deliver relevant advertising. We may use Google Analytics, Google Tag Manager, and similar analytics tools.
 
You can control cookies through your browser settings. Blocking certain cookies may impair the functionality of the Xeebi Services. Most browsers accept cookies by default; you can usually modify your browser settings to decline cookies.

Data Retention

We retain your personal information for as long as your account is active or as needed to provide the Xeebi Services, comply with our legal obligations, resolve disputes, and enforce our agreements. When we no longer need personal information, we securely delete or anonymize it.

Specifically:
 
-  Account Data: retained for the duration of your account plus up to 3 years after account closure for legal and audit purposes.
-  Payment Records: retained for 7 years as required by financial regulations.
-  Message Logs: delivery logs retained for 90 days; content logs may be retained for up to 1 year for dispute resolution purposes.
-  Consent and Opt-Out Records (TCPA): retained for a minimum of 5 years to comply with applicable law and to defend against potential claims.
-  Backup Copies: may persist in encrypted backup systems for up to 90 additional days after deletion from primary systems.

Data Security

We implement appropriate technical and organizational security measures designed to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These measures include encryption of data in transit (TLS/SSL) and at rest, access controls and authentication requirements, regular security assessments, and employee training on data protection.

However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. You are responsible for maintaining the security of your account credentials and for any activity that occurs under your account.

In the event of a data breach that affects your personal information, we will notify you as required by applicable law.

Children's Privacy

The Xeebi Services are not directed to individuals under the age of 18, and we do not knowingly collect personal information from children under 18. If we become aware that we have inadvertently collected personal information from a child under 18 without parental consent, we will take steps to delete such information promptly. Your Rights and Choices

Depending on your location, you may have the following rights with respect to your personal information:
 
Access and Portability. You may request a copy of the personal information we hold about you in a structured, machine-readable format.
 
Correction. You may request that we correct inaccurate or incomplete personal information. You can update most account information directly through your account settings.
 
Deletion. You may request deletion of your personal information, subject to certain exceptions (e.g., information we are required to retain by law, information necessary to complete pending transactions, or information needed to defend legal claims).
 
Opt-Out of Marketing. You may opt out of receiving marketing communications from us by following the unsubscribe link in any marketing email or by contacting us at sales@xeebi.ai. Note that you will continue to receive transactional or service-related communications.
 
Restriction and Objection. In certain circumstances, you may have the right to restrict our processing of your personal information or to object to certain processing activities.

California Privacy Rights

If you are a California resident, the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) provide you with additional rights regarding your personal information.
 
Categories of Personal Information Collected. In the preceding 12 months, we have collected the following categories of personal information: identifiers (name, email, IP address); commercial information (payment records, transaction history); internet and network activity (usage data, log data); professional or employment-related information (company, role); and inferences drawn from the above.
 
Right to Know. You have the right to request disclosure of: (a) the categories and specific pieces of personal information we collected about you; (b) the categories of sources from which we collected personal information; (c) the business or commercial purpose for collecting your personal information; and (d) the categories of third parties with whom we shared your personal information.
 
Right to Delete. You have the right to request that we delete personal information we collected from you, subject to certain exceptions.
 
Right to Correct. You have the right to request correction of inaccurate personal information.
 
Right to Opt-Out of Sale or Sharing. We do not sell personal information as defined under the CCPA, nor do we share personal information with third parties for cross-context behavioral advertising.
 
Right to Non-Discrimination. We will not discriminate against you for exercising any of your CCPA rights.

You may also use an authorized agent to submit a request on your behalf; the agent must provide proof of authorization and you must verify your identity with us directly.

International Data Transfers

Xeebi Mobile Inc. is based in the United States. If you access the Xeebi Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country. By using the Xeebi Services, you consent to the transfer of your information to the United States. We will take appropriate safeguards to ensure your personal information remains protected in accordance with this Privacy Policy.

Third-Party Websites and Services

The Xeebi Services may contain links to third-party websites, applications, or services. This Privacy Policy does not apply to those third-party services, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party services you access through the Xeebi Services.

When you connect third-party accounts or services to the Xeebi Services (such as CRM platforms, social media accounts, or telecommunications providers), those third parties may collect information about you in accordance with their own privacy policies.

Do Not Track

Some web browsers allow users to transmit a "Do Not Track" signal. Because there is no industry standard for how companies should respond to Do Not Track signals, we do not currently alter our data collection and use practices in response to such signals. We will continue to monitor developments in this area and update this section accordingly.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. We will update the "Last updated" date at the top of this page when we make changes. For material changes, we will provide more prominent notice, such as an email notification to the address associated with your account or a banner on our website.
